TERMS OF SERVICE

The following Terms apply to Garden City Harvest, Inc., a Montana based nonprofit (tax ID 81-0510580). By accessing and using the Garden City Harvest website (http://www.gardencityharvest.org) and Garden City Harvest services for which you voluntarily register, you agree to be bound by these Terms of Service and our Privacy Policy around user data. 

You agree to be bound by these Terms if you are doing any of the following:

  • Accessing or using www.gardencityharvest.org or any other websites linking to these Terms of Service.

  • Accessing or using any Garden City Harvest services made available such as making a donation, registering for a program or event, signing up for a newsletter, or opting in to text messaging. 

ACCEPTANCE OF TERMS

By accessing and using the Garden City Harvest website or services, you signify that you have read, understand, acknowledge and agree to be bound by the following Terms of Service:

You acknowledge that these Terms of Service are supported by reasonable and valuable consideration, the adequacy of which are hereby acknowledged. It is the responsibility of you, the user, to read the terms and conditions before proceeding to use this site. If you do not agree to all of the Terms, you are prohibited from using or accessing this site.

We reserve the right, in our sole discretion, to modify these Terms of Service as appropriate, and we will make reasonable efforts to provide you with notice if these Terms are updated. The updated Terms will be effective as of the time of posting, or such later date as may be specified in the updated Terms and will apply to your use of the Garden City Harvest website and services.

RULES OF CONDUCT

You acknowledge and agree that:

  1. You will not use the Garden City Harvest website, posting platforms, or services in connection with spamming, junk email, or unsolicited messaging. You will not harvest or collect contact information of other users of the website for the purposes of sending spam.

  2. You will not publish, post, upload, distribute or disseminate any profane, defamatory, obscene, indecent or unlawful content.

  3. You will not reverse engineer any aspect of the Garden City Harvest website to extract data.

  4. You will not upload files that knowingly contain viruses or any similar software or programs that may damage the operation of another’s computer or property.

  5. You will not violate any applicable laws or regulations.

  6. You will not create a false identity for the purpose of misleading others.

  7. Garden City Harvest takes no responsibility and assumes no liability for any content posted, stored, or uploaded by you or any third party.

  8. Garden City Harvest reserves the right to remove any content that is deemed offensive, harmful to others, or illegal.

MOBILE MESSAGING

If you select mobile messaging, Garden City Harvest will send you an average of four text messages per month. For help, contact info@gardencityharvest.org. Text STOP to opt-out of mobile messaging. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

PRIVACY POLICY

Garden City Harvest respects your right to privacy and is committed to protecting your information online. We do not sell or rent any information you voluntarily provide us through our website or through any means of communications with this organization. This Privacy Policy applies to www.gardencityharvest.org , and was created to inform you about the ways in which we collect and use this information. Garden City Harvest does not collect any information from you without your knowledge and permission, and we do not ask that you enter any personal information to access or use most areas of our website. Your continued use of the Garden City Harvest website constitutes your agreement to the following Privacy Policy, as it may be periodically amended.

PERSONAL DATA COLLECTED

We may collect your personal data when you submit forms such as program registration, event registration, newsletter registration, or to make an online donation. Garden City Harvest does not disclose this information to anyone externally, and the primary use of this data is to identify you as part of registering for a particular product or service. Information you provide to Garden City Harvest is stored in a secure location and is accessible only by designated staff. Data we may collect includes your:

  • Name

  • Email address

  • Telephone number(s)

  • Mailing address

  • Credit card information (for donations and / or paid program registration, managed through a PCI compliant third-party data processor)

  • Donation history with Garden City Harvest (with the option of being reported as “anonymous”) *more below under “secure transactions”

  • Data provided voluntarily in Garden City Harvest program or event survey responses

  • Social media profile information (optional, and voluntarily collected through donation forms)

Garden City Harvest will not disclose this information to anyone except in accordance with any rules you agree to as consent and, as described above, to manage our database with the help of service providers who are subject to a non-disclosure agreement. 

Secure transactions

When financial transactions are made through the Garden City Harvest website (including voluntary donations, program registrations, program payments, workshop registrations) your information is encrypted and transmitted via a secure connection. Garden City Harvest uses your credit card information for the sole purpose of processing your financial transaction. We will never disclose this information except as necessary to process your financial transaction and we do not store or have access to your full information once your transaction has been completed.

ADDITIONAL WAYS WE MAY COLLECT AND USE YOUR DATA

  • Email information- email correspondences that you send us

  • Phone information- if you sign up to receive texts from Garden City Harvest

  • Social media information- if you engage with Garden City Harvest on social media, that information is collected in our social media pages

  • Event attendance- if you sign up for an event we are organizing or attending, information that you provide may be gathered

  • Survey information- when we conduct surveys, your participation is entirely voluntary. Your results will be collected for reporting purposes, and to help us improve our program offerings, outreach, and overall work. Most surveys can also be taken anonymously.

Web logs and analytics

Garden City Harvest maintains standard web logs that record basic information about visitors to our website. These logs may contain:

  • Your IP address

  • Type of browser and operating system

  • The date and time you visited the site, and the pages you saw

  • Keywords used to find the Garden City Harvest website through your search engine and collected by Google Analytics

We use this information to better design our website, identify popular topics of interest, and in other similar ways. We do not identify individuals from our web logs or link this information to other user information. However, if someone tries to damage our website or use it in an unauthorized or illegal way, we may share this information with law enforcement agencies. 

Communications from Garden City Harvest

If you have opted to receive any email communications from Garden City Harvest (updates, publications, and so on) you are able to unsubscribe at any time following the directions that appear in the footer of the email, or by contacting our main office. We will retain and use your collected data for the duration of our relationship with you as long as you are a member of the Garden City Harvest communications community. You are able to opt out of any communications with Garden CIty Harvest at any time.
